Topic: The Cost of Not Knowing Your Rights

At least once a week someone calls me who had a serious on-the-job injury several years ago and wants to know what they can do about it now. Frequently these cases were closed because the injured workers "slept on their rights," and didn't get help when something had to be done to keep the case open. Sometimes I can help them reopen their case so they can get the benefits they have coming to them. However, far too often the case has been closed too long and there is nothing anyone can do to resurrect it.

For these reason, I always advise injured workers to at least talk to an attorney. Most workers compensation attorneys are more than willing to evaluate a case over the phone and tell you what needs to be done. It may not always be possible to find an attorney to take case. There are many factors that determine whether an attorney wants to become involved. However, you still owe it to yourself to get some free advice before it's too late. Remember, insurance companies are experts in adjusting your claim. You are not an expert in defending your rights. I advise anyone who has an on-the-job injury to spend at least a few minutes on the phone with an experienced workers compensation attorney. Find out what rights you have, and what you may be giving up by doing nothing.
